2. Original Paintings and Authenticity

All paintings offered for sale through Davis Gallery are unique, original works of art created by Davis Lisboa.

Each painting is accompanied by relevant information, including its title, medium, support, dimensions, price and availability.

Photographs are intended to represent the paintings as accurately as possible. Minor colour variations may occur due to screen settings and lighting conditions. Such variations do not affect the buyer’s statutory rights if a painting does not conform to its description.

Every original painting is supplied with a certificate of authenticity signed by the artist.

Davis Gallery is committed to providing accurate, clear and sufficient information to enable buyers to make informed purchasing decisions.

3. Prices and Taxes

All prices are displayed in the currency indicated on the website.

The applicable price, taxes and any additional shipping charges will be disclosed before the customer confirms a purchase.

Where customs duties, import taxes or other local charges may apply to international shipments, buyers will be informed of the relevant conditions before placing an order, insofar as such information can reasonably be determined.

Promotional prices and discounts apply exclusively in accordance with the terms expressly stated for each promotion.

Davis Gallery does not impose undisclosed charges after an order has been placed.

4. Orders and Payments

Customers may select an available painting, review their order and complete the purchase using the payment methods offered on the website.

Before submitting an order, customers may review the information they have entered and correct any errors.

An electronic acknowledgement of receipt of the order will be sent to the email address provided by the buyer.

The steps involved in placing an order, the point at which a binding contract is formed, and any payment authorisation or verification requirements will be clearly indicated during checkout.

If a painting unexpectedly becomes unavailable or cannot be supplied, Davis Gallery will inform the customer without undue delay and refund any payment received.

5. Availability of Original Paintings

Each original painting is a unique work of art, and only one original exists.

Availability is subject to confirmation at the time of purchase.

Once a painting has been sold, it will no longer be listed as available for purchase on Davis Gallery.

Davis Gallery will not substitute a purchased painting with another artwork without the buyer’s express consent.

6. Packaging, Shipping and Delivery

Paintings are carefully prepared for transport using appropriate protective packaging, taking into account their materials, dimensions and fragility.

How Will Your Original Painting Be Packaged?

The following video demonstrates the preparation and packaging of an original painting by Davis Lisboa. It provides buyers with a visual explanation of the care taken to protect artworks during transport.

Available shipping destinations, shipping costs and applicable delivery times will be communicated before the purchase is completed.

Estimated delivery times do not constitute guaranteed delivery dates unless expressly agreed otherwise.

In the event of an unforeseen delay, Davis Gallery will inform the buyer and provide the options required under applicable consumer protection law.

Where Davis Gallery arranges transport, the risk of accidental loss or damage will generally remain with the seller until the buyer, or a person designated by the buyer other than the carrier, takes physical possession of the painting, subject to any applicable legal exceptions.

Buyers are encouraged to inspect the packaging and painting upon delivery and report any visible damage as soon as reasonably possible.

Failure to report damage immediately does not affect the consumer’s statutory rights.

7. Right of Withdrawal and Returns

Consumers purchasing original paintings online generally have a statutory right to withdraw from the purchase within 14 calendar days of receiving the artwork, without giving any reason.

To exercise this right, the buyer must notify Davis Gallery of their decision to withdraw before the applicable deadline by emailing info@davis-gallery.com. Buyers may use the model withdrawal form provided at the end of this document or submit any other unequivocal statement of their decision.

The buyer must return the painting without undue delay and, in any event, within 14 calendar days of notifying Davis Gallery of the withdrawal, unless Davis Gallery agrees to collect it.

Where a return is made solely because the buyer has changed their mind, the buyer will bear the direct cost of return shipping, provided that this responsibility and any legally required information concerning return costs were communicated before purchase.

As original paintings may require specialised transport, buyers are encouraged to contact Davis Gallery before arranging a return.

Davis Gallery will provide reasonable guidance on protecting the painting during return transport. Reusing the original packaging is recommended where appropriate and available, but retaining the original packaging is not a condition for exercising the statutory right of withdrawal.

The buyer may be liable for any reduction in the painting’s value resulting from handling beyond what is necessary to establish its nature, characteristics and condition, in accordance with applicable law.

Davis Gallery will reimburse all amounts required by law, including the original standard delivery charges where applicable, within 14 calendar days of receiving the withdrawal notification.

Unless Davis Gallery has offered to collect the painting, it may withhold reimbursement until it has received the artwork or the buyer has provided evidence of having returned it, whichever occurs first.

Refunds will be made using the same payment method as the original transaction, unless expressly agreed otherwise and provided that the buyer incurs no additional fees.

An existing original painting is not excluded from the statutory right of withdrawal merely because it is unique, signed or purchased at a promotional price.

8. Damaged, Incorrect or Non-Conforming Paintings

Davis Gallery is responsible for supplying paintings that correspond to their agreed descriptions and meet applicable legal requirements.

If a painting arrives damaged, is incorrect or does not conform to the contract, the buyer may contact Davis Gallery at info@davis-gallery.com and provide relevant information, including photographs where reasonably possible.

Davis Gallery will assess the situation and provide the remedy required by applicable law, which may include appropriate repair, replacement where possible, a price reduction or a refund.

Because original paintings are unique works of art, an identical replacement may not be possible.

Where Davis Gallery is legally responsible for a defective or non-conforming painting, the buyer will not be required to bear costs that applicable law assigns to the seller.

These rights are separate from, and additional to, the statutory right of withdrawal.

9. Copyright and Reproduction Rights

Unless expressly agreed otherwise in writing, purchasing a painting transfers ownership of the physical artwork only.

Copyright and other intellectual property rights remain with Davis Lisboa or their respective lawful owners.

Purchasing a painting does not automatically grant permission to reproduce it commercially, manufacture derivative products, license its image or exploit it for advertising purposes.

Buyers may enjoy, display, resell or otherwise use their physical painting within the limits established by applicable law.

Nothing in these Terms and Conditions restricts any intellectual property rights granted to the buyer by law.

10. Promotions and Special Offers

Promotions apply exclusively to the paintings, dates and conditions expressly identified in each offer.

Where a price reduction is advertised, the reference price will be determined in accordance with applicable law.

Unless expressly stated otherwise, promotions do not apply retrospectively to previous purchases or to other paintings.

Promotional discounts do not reduce or limit consumers’ statutory rights.

11. Customer Service and Complaints

Davis Gallery is committed to handling customer enquiries and complaints fairly, clearly and within a reasonable timeframe.

Customers may contact the gallery using the following details:

Email: info@davis-gallery.com

Postal address: Carrer de Puigmartí, 7, 1, 2, 08012, Gràcia, Barcelona, Spain

Customers are encouraged to include their order number and a description of the issue, where applicable.

Davis Gallery will assess complaints individually and seek a reasonable resolution in accordance with applicable law.

Consumers retain the right to contact the competent consumer protection authorities or use any legally available dispute resolution mechanisms.

12. Privacy and Personal Data

Personal data collected during the purchasing process will be processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Information about the collection, processing and retention of personal data, as well as data subjects’ rights, is available in the website’s Privacy Policy.

Payment information is processed through the payment service providers offered during checkout, in accordance with their applicable security and privacy requirements.

13. Applicable Law and Consumer Rights

These Terms and Conditions are governed by Spanish law, without prejudice to any mandatory consumer protection provisions applicable in the buyer’s country of habitual residence where required by law.

Nothing in these Terms and Conditions excludes or limits rights that cannot legally be waived.

Disputes will be submitted to the courts or competent authorities determined by applicable law. No provision of these Terms and Conditions requires consumers to waive any jurisdictional protections to which they are legally entitled.

14. Changes to These Terms and Conditions

Davis Gallery may update these Terms and Conditions to reflect changes in its business activities or applicable legislation.

The terms applicable to each order will be those made available to the buyer at the time the contract is concluded, without prejudice to mandatory legal provisions.

Subsequent changes will not retroactively remove rights already acquired by customers.
